Terms and Conditions of Service

1. Service Provider Identification
Aura (somosaura.app) is a product of ISALASH — Alvaro Fabián Sánchez Sterling, sole proprietor, commercial registration No. 382204 (Chamber of Commerce of Huila, Colombia), Tax ID (NIT) 1079410369-1, domiciled in Pitalito, Huila, Colombia.
2. Acceptance of Terms
By accessing and using Aura SaaS (hereinafter, "the Platform" or "Aura"), you agree to be bound by these Terms and Conditions. If you represent a business ("The Business" or "Data Controller"), you accept these terms on behalf of your entity.
3. Intellectual Property
Aura is the exclusive owner of all intellectual property rights over the source code, user interface, brand, and designs associated with the Platform. Affiliated businesses are the exclusive owners of the data collected in their agenda and the information of their clients ("Data Subjects").
4. Use of Payment Gateways
For subscription management, Aura uses Wompi as a payment gateway, which complies with PCI-DSS security standards. Aura does not store your credit card details at any time; it only manages subscriptions provided by the gateway.
5. Limitation of Liability ("As-Is")
The Platform is provided "as is" and "as available". Aura does not guarantee that the service will be uninterrupted or error-free. Aura assumes no liability for loss of profit, loss of sales, interruptions derived from third-party API failures (such as Meta Graph API for WhatsApp, or payment gateways), nor does it guarantee any financial result to the Business.
6. Causes for Suspension
Aura reserves the right to suspend or cancel the service in the following cases:
- Arrears exceeding the stipulated grace days in the payment of the monthly subscription.
- Use of the messaging system (WhatsApp) for sending SPAM, phishing, or any unsolicited communication that violates Meta's policies.
- Use of the platform for illegal activities or contrary to good faith.
7. Choice of Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be resolved exclusively in the competent courts located in Bogota, Colombia.
8. Class Action Waiver (U.S. Users)
Any proceeding to resolve or litigate any dispute in any forum will be conducted solely on an individual basis. Neither you nor Aura will seek to have any dispute heard as a class action, private attorney general action, or in any other proceeding in which either party acts or proposes to act in a representative capacity. No arbitration or proceeding will be combined with another without the prior written consent of all parties to all affected arbitrations or proceedings.
9. Modifications to the Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the Platform or by email.
